These Terms govern your use of the NonStopDialer Android application and the associated website at nonstopdialer.com, referred to below as "we," "us," or "NonStopDialer." By downloading, installing, or using the app, you agree to these Terms.
1. What NonStopDialer is
NonStopDialer is a SIM-based auto-dialer app for Android. It places calls through your device's own phone line using the device's native calling system. It is not a VoIP service, does not route calls over the internet, and does not provide its own phone numbers or minutes. You need an active SIM card and calling plan with your own mobile carrier to make or receive calls through the app.
2. Accounts and eligibility
You need an account to use NonStopDialer beyond the initial trial. You're responsible for keeping your login credentials secure and for all activity under your account. You must be legally able to enter into an agreement in your jurisdiction to create an account.
3. Device licensing
Each account is licensed to one active device at a time. You can transfer your license to a new device yourself from within the app. Attempting to bypass this device-binding, including through modified builds of the app, is a breach of these Terms.
4. Subscription plans and billing
NonStopDialer is offered on a free tier and several paid subscription tiers, described on our pricing page. Manual calling is unlimited on every tier; paid tiers remove or raise the cap on how many numbers can be processed by the automated dialer per list.
Paid subscriptions are billed and processed by Paddle.com, our payment provider and merchant of record. Paddle handles payment collection, invoicing, and applicable sales tax or VAT on our behalf. Your relationship for billing purposes is with Paddle as merchant of record, in addition to your service relationship with us.
Subscriptions renew automatically each billing period until cancelled. You can cancel at any time; your access continues until the end of the period you've already paid for.
5. Refunds
Refunds are handled according to our Refund Policy.
6. Do Not Call lists and acceptable use
NonStopDialer includes tools to help you stay compliant: Do Not Call list management, calling-hours restrictions that limit when auto-dial can run, and a consent confirmation step before bulk lead uploads. These tools support your compliance efforts; they don't replace them, and using them doesn't itself make any particular calling campaign lawful.
You're solely responsible for having a lawful basis to contact every number you upload or dial through the app, and for complying with the telemarketing, data protection, and consumer protection laws that apply to your calling activity and to the individuals you contact, including (where applicable) the Telephone Consumer Protection Act (TCPA) in the United States, the UK/EU Privacy and Electronic Communications Regulations (PECR) and GDPR, and any local Do Not Call regulations in the markets you call into.
You may not use NonStopDialer to make calls that are unlawful, harassing, fraudulent, or that violate a recipient's do-not-call preference once recorded in the app. We may suspend an account we reasonably believe is being used this way, without it counting as a breach of our obligations to you.
7. Data you import
When you import contact lists (CSV or Excel) into the app, you're responsible for having a lawful basis to hold and call the numbers in that list. We store and sync the lead data you import so it can back up across devices and, for team accounts, so it can be reported on within your organization. See our Privacy Policy for details on how that data is handled.
Where the contacts in your lists include individuals located in the UK or EU, we act as a data processor with respect to that contact data, and you (or your organization) act as the data controller. We process it only to provide the service to you, don't sell it, and don't share it with third parties beyond what's needed to run the service, as described in our Privacy Policy. Deletion requests for your account and its data are handled per that policy.
8. Team and organization accounts
Agency-tier accounts can invite team members, who become bound by these Terms individually. The account owner or admin who creates the organization is responsible for managing seats, invitations, and removing members who should no longer have access.
9. Suspension and termination
We may suspend or terminate an account that breaches these Terms, including attempts to circumvent device licensing, abuse of the Do Not Call tooling, or non-payment. You can stop using the app and delete your account at any time by contacting us.
10. Availability and changes to the service
NonStopDialer is under active development. Features may be added, changed, or removed over time, and we'll do our best to communicate material changes that affect paid functionality. We don't guarantee uninterrupted availability of the app or backend services.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your calling activity and the lists you upload or dial; your violation of any telemarketing, data protection, or consumer protection law; your violation of these Terms; or your violation of any third party's rights, including a contact's right not to be called.
12. Limitation of liability
NonStopDialer is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or free of issues arising from your mobile carrier's network, your device, or third-party services we depend on.
To the fullest extent permitted by law: we're not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including lost calls, lost leads, lost profits, or business interruption; and our total aggregate liability to you for any claim arising from these Terms or your use of the app is limited to the amount you paid us in the 12 months before the claim arose, or USD 100 if you're on the free tier. Nothing in these Terms limits liability that can't legally be limited, such as liability for our own fraud or gross negligence.
13. Governing law and disputes
These Terms are governed by the laws of Pakistan. Any dispute that can't be resolved informally will be subject to the courts of Islamabad, Pakistan. We aim to resolve any dispute directly and in good faith before either party pursues formal action. Nothing in these Terms limits any statutory consumer protection rights you have under the law of your own country of residence, and those rights take precedence over anything in this section that would conflict with them.
